GENERAL CONDITIONS OF SALE

1.DEFINITION OF AN ORDER

An order is binding and irreversible for the purchaser.  It shall be considered final as of when the payment is made by the purchaser according to the provisions specified hereafter.  An order shall only be considered valid if the destination of the goods is located on European Union territory.  Deliveries outside the E.U. shall be processed on a case by case basis.

Some items cannot be exported to countries where patents or copyright for third parties apply.

When submitting the order form, the customer also declares that he or she has carefully read the terms and conditions in their entirety and accepts them all.

2.TERMS OF DELIVERY

The delivery time stipulated for delivery shall be considered approximate and commences as of the date of reception of the payment for the goods in question.  Delivery should take place within five to six weeks.  The supplier company shall not be held liable for delays in delivery or no delivery at all ( attributable to reasons beyond its control , fortuitous reasons, or cases of “force majeure).

3.FREIGHT

The goods shall be transported by road.  The consignment shall be delivered to the address provided on the order form and deposited at the pavement level .  The haulier is not obliged to carry the goods in from the street to the house or apartment in question. Goods must be checked upon arrival. Any possible damage must be ascertained at this moment and any comment on the state of the packaging or any other defect must be reported in writing on the accompanying invoice.


Complaints shall be lodged within 8 days of receiving the goods.  After this period the goods shall be considered approved.

4. PRICES : The price list on the site does not include VAT or shipping costs.
20 %VAT is applied to sales in Italy and for private clients in the European Union who do not have a VAT number ( private individuals).

TRANSPORT costs to Italy amount to 7% of the value of an order exceeding € 715,00. For lower amounts a flat rate charge of € 50,00 shall apply.

TRANSPORT costs to Italy amount 7% of the value of an order exceeding € 715,00. For lower amounts a flat rate charge of € 50,00 shall apply.

Transport costs to  AUSTRIA, BELGIUM, THE NETHERLANDS, FRANCE and GERMANY shall amount to 15% of the value of any order exceeding € 530,00; for smaller amounts a flat rate of € 80 per consignment shall apply.

 Transport costs to  SPAIN, GREECE, GREAT BRITAIN, PORTUGAL,
SWEDEN, DENMARK, POLAND, IRELAND and FINLAND shall amount to 19,50% of the value of any order exceeding € 530; for lower amounts a flat rate of € 105,00 per consignment shall apply.

Transport costs to  SWITZERLAND shall amount to 23% of the value of any order exceeding € 530,00;for lower amounts a flat rate of € 120,00 per consignment shall apply.

5.METHODS OF PAYMENT

The payment validates and sets the order process in motion.  It can be made in the following way:

   1. Advance payment by credit card
   2. Paypal
   3. Bank transfer

6.DATA AND MEASUREMENTS

Weights, measurements, technical data, colours and illustrated prospectuses shall be considered approximate and not binding and Armonia Design may decide on a variant or minor change where appropriate.  This does not attribute any right to the purchaser to query the goods, or ask for a price rebate.

7.GUARANTEE

ARMONIA DESIGN guarantees the quality of its merchandise during the specified guarantee period and undertakes to repair or replace free of charge, as soon as possible, any parts which present a flaw attributable to a defect in the quality of the material used or the production method.

This shall not apply to damage caused by inexpert handling , improper use or negligence on the part of the purchaser such as overloading, changes made to the article without prior notification, altering or tinkering and causing damage in general.  In particular natural products such as Vienna straw and hand woven cane used for some articles.  No guarantee is given to the company when acquiring these raw materials and improper use can lead to irreparable damage which is not at all linked to the quality of the product. The guarantee does not apply in these cases.

The guarantee period is two years from the moment of delivery.  Expenses incurred for the replacement  or repair of the article in question during the guarantee period shall be born by Armonia Design with the exception of the freight costs necessary to replace the flawed products.

The purchaser shall not be entitled to any compensation during the period in which the acquired article is not at his/her disposal.  No compensation or  indemnity for expenditure incurred for direct or indirect damage caused by the observed defect shall be recognized.

8. RETURNS POLICY

The purchaser shall be entitled to rescind from the contract within 8 days of receiving the goods and shall express his/her wish to do so by signed for registered letter .  The purchaser shall return the merchandise with its original wrapping no later than 15 days after he/she has received it and shall bear all the freight costs inherent in his/her decision.  Upon reception of the returned goods, Armonia Design shall inspect them and once it is ascertained that they are intact and not damaged in any way, proceed with the reimbursement of the amount paid minus the freight costs as in point 4.  If the goods are damaged  no refund shall be paid to the customer In conformity with article 5 of DL 22/05/1999, N°185, paragraph 3, sub paragraph c.  No right to a refund is recognized for goods made to measure and/or clearly bespoken.

9.PRIVACY (Law D.I.Lgs 196/2003)

The purchaser shall authorize Armonia Design to process the data received and to pass on the information to third parties in order to meet all legal requirements.  All the rights defined in article 7 of Law No D.Lgs 196/2003 shall be recognized.

10. COMPETENT JUDICIAL AUTHORITY

The judicial authority of Florence shall be competent to handle any dispute which might arise.
 
QUALITY OF MATERIALS
 
All colours (be they natural or obtained from dyes) may vary in shade from one batch to the next.
This might pose matching problems if orders for items of the same colour are staggered over time.

 
 
These differences cannot be considered flaws and shall not give rise to complaints or replacements.
 
VIENNA STRAW
Vienna straw consists of approximately 2 mm wide and 1 mm thick, thin wooden strips obtained from the external layer of bamboo cane. This is then machine woven according to the traditional pattern with its hexagonal shapes and then placed in a solid beech frame.
It is commonly called” Vienna straw” and became famous because it is used for the circular shape of the seat of the so-called “Viennese” wooden chair.
Since this is made with natural products, any improper handling can determine irreparable damage which cannot in any case be attributed to the quality of the product nor lead to the application of the guarantee.  
HAND WOVEN CANE
Here too approximately 6 mm wide and 2mm thick, thin wooden strips obtained from cane are used.  These are hand woven on metal frames.
Since this is a natural product, any improper handling can determine irreparable damage which cannot in any case be attributed to the quality of the product nor lead to the application of the guarantee.

FABRIC
Mixed “LINOSA” linen.
This natural fibre (63% cotton - 37% linen) contains a medium to large weft.  It is fairly thick and very resistant to wear and tear.
 
FAUX LEATHER  
LEDITEX MISTRAL
This is a leather surrogate and consists of an acrylic compound of 76% plasticized P.V.C. and 24% Polyester.  It is about 1 mm thick and is fairly resistant to wear and tear.
 
LEATHERS:  
VICTORY CONTRACT LEATHER
This leather is approximately 0.8/1 mm thick and partly or totally milled.  Grain enhancement is also carried out.  
 
             
FULL GRAIN CAT.A GEORGIA LEATHER

This 1.2/1.4 mm thick leather has a completely natural grain and is produced with Aniline dye.
 
CONTRACT LEATHER

This 2.4/2.6 mm thick leather is completely embossed with grain enhancement covering the entire surface.      
  
“GROPPONE”
This is 3.5/4 mm thick and partly finished with grain embossment over the entire surface.
 
“FULL GRAIN”
This leather is 2.5/2.8 mm thick and is totally natural grain.
 
Leather and hide are natural products! – The totally natural grain versions may contain slight imperfections such as scratches, scars, streaks, marks and a grain which varies considerable according to the part of the anatomy used.  These are “signs” which attest to the naturalness of the products and cannot be considered flaws.  
 
All leathers and hides are coloured with dyes! – The only exception is the “NATURAL FULL GRAIN” which does not undergo any type of colouring. - This leads to a gradual change in the colour which goes from “beige” at the beginning to an increasingly darker shade of brown. Because it is very absorbent, it can stain very easily.  
 
PONY
These are skin hides which are coloured completely naturally. If you choose an item upholstered in pony skin you have to be” mentally prepared “to accept the “irregularities of nature” whereby there are no hard and fast rules with regard to the intensity and distribution of colours.  In other words a black and white pony skin may be nearly totally white with a few black stains or nearly totally black with a few white stains.  This does not give rise to any grounds for a complaint or for the right to a replacement.
